The Panel Advised:

 

Decision

A.            The Ku-ring-gai Local Planning Panel, as the consent authority, being satisfied that the proposed development will be in the public interest, grants development consent to DA0040/19 for significant alterations and additions including a swimming pool, detached garage and associated works - heritage item at 20 Cyrus Avenue, Wahroonga, subject to conditions as per the officer’s assessment report.

 

B.           The date of the decision: 18 November, 2019

 

C.            Reasons for the decision: The Panel accepts the officer’s assessment report and recommendation, after visiting the site.

 

D.           How community views were taken into consideration: There was one submission but no speakers. The Panel notes the officer’s response to the submission in the assessment report and found that satisfactory.

Decision

 

A.            The Ku-ring-gai Local Planning Panel, as the consent authority, defers determination of the development application with the applicant to provide:

 

a)      revised civil design plans, including architectural drawings and arborist reports for the proposed driveway to Junction Road. The sections are to be provided at 1:100 scale

 

b) an easement for a mailbox on the plans for Lot 2

 

B.            The date of the decision: 18 November, 2019

 

C.            Reasons for the decision: The Panel identified an inconsistency between the submitted civil design plans and the site survey plans after visiting the site.

 

D.            How community views were taken into consideration: There was one submission with no speakers on the day.

11-17 Gladstone Parade, Lindfield - Demolition of existing structures and construction of a multi-dwelling housing development consisting of 18 units with basement parking and associated works and strata subdivision

The Panel Advised:

 

Decision

 

A.            The Ku-ring-gai Local Planning Panel, as the consent authority, is of the opinion that the request submitted under clause 4.6 of KLEP 2015 to vary the floor space ratio development standard of Clause 4.4 (2A) of the Ku-ring-gai Local Environmental Plan 2015 has met the requirements of clause 4.6(4). The Ku-ring-gai Local Planning Panel is also of the opinion that strict compliance with the development standard is unreasonable and unnecessary in the circumstances of the case and that there are sufficient environmental planning grounds to justify the variation to the development standard.

 

B.           The Ku-ring-gai Local Planning Panel, as the consent authority, being satisfied that the proposed development will be in the public interest, grants deferred commencement development consent to DA0542/18 to demolish existing structures and construct a multi-dwelling housing development consisting of 18 units with basement parking and associated works and strata subdivision at 11-17 Gladstone Parade, Lindfield, subject to conditions as per the Development Assessment Report and an amendment to Condition 11 and an additional part to Condition 31 being:

 

Amendment to Condition 11 to be added as a dot point:

 

·         Tree protection fencing in accordance with Appendix 6 of the approved arborist’s report.

 

Condition 31 to be added as a dot point:

 

·         Privacy screening is to be provided to the western side of the first floor balcony and to the western side of the ground floor private open space area to Unit 07.  The screening shall attain a height of 1.6 metres above the finished balcony level and the finished ground level.

 

C.               Pursuant to Section 4.53(6) of the Environmental Planning and Assessment Act 1979, this consent lapses if the applicant fails to satisfy the consent authority as to the matters specified in the deferred commencement terms within 24 months of the date of the Notice of Determination. Pursuant to Section 4.53(2) of the Environmental Planning and Assessment Act 1979, this consent lapses if the approved works are not physically commenced within two years from the date on which the development consent becomes operable.

 

D.           Date of the decision: 18 November, 2019

 

E.            Reasons for the decision : The Panel accepts the officer’s assessment report and recommendation, after visiting the site and hearing from the speakers at the meeting.

 

E.            How community views were taken into consideration: There were eight submissions and three speakers on the day. The Panel notes the officer’s response to the submissions in the assessment report and found that satisfactory.

 

Voting:        unanimous
