Modification to Land and Environment Court Consent 301333 of 2019 (DA0316/19) proposing internal and external amendments to the approved development, changes to the unit mix and associated works

 

 

The Panel Advised:

 

A.    Ku-ring-gai Local Planning Panel, exercising the functions of Ku-ring-gai Council, under Section 4.56 of the Environment Planning and Assessment Act 1979, modified the development consent to DA0316/19 for a residential apartment development in the manner proposed in modification of consent application eMOD0233/24 at 900 Pacific Highway Gordon, subject to the recommended conditions as per the Development Assessment (Modification) Report.

B.    Date of decision: 14 April 2025

C.    Reason for the decision: The Panel concurs with the recommendation in Council’s Development Assessment Report.

 

D.    How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were three submissions which was considered in the assessment and determination of the application.

The Panel Advised:

 

A.    Ku-ring-gai Local Planning Panel, exercising the functions of Ku-ring-gai Council, as the consent authority, under Section 4.16 of the Environment Planning and Assessment Act 1979, refused development consent to eDA0546/24 for alterations and additions to the existing dwelling and detached garage and studio, modified driveway and associated works on land at 56 Treatts Road, Lindfield, for the reasons provided in the Development Assessment Report.

B.    Date of decision: 14 April 2025

C.    Reason for the decision: The Panel concurs with the recommendation in Council’s Development Assessment report.

 

D.    How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were no submissions.

Conversion of dwelling house to a centre-based childcare facility and construction of a new childcare building, with basement carparking and associated works including stormwater works within an easement on the adjoining property at 81 Coonanbarra Road, Wahroonga.

 

 

The Panel Advised:

 

A.    Ku-ring-gai Local Planning Panel, exercising the functions of Ku-ring-gai Council, as the consent authority, under Section 4.16 of the Environment Planning and Assessment Act 1979, refused development consent to eDA0478/24 for conversion of dwelling house to a centre-based childcare facility and construction of a new childcare building with basement carparking and associated works on land at 16 Burns Road, and 81 Coonanbarra Road, Wahroonga, for the reasons provided in the development assessment report, subject to the deletion of the reason for refusal 12(b).

 

B.    Date of decision: 14 April 2025

C.    Reason for the decision: The Panel concurs with the recommendation in Council’s Development Assessment report.

 

D.    How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were 65 submissions, including 1 petition containing 690 signatures, which were considered in the assessment and determination of the application.
