Demolition of existing structures, Torrens title subdivision of one lot into two and construction of a new dwelling and associated works on proposed Lot 1.

 

The Panel Resolved:

 

PURSUANT TO SECTION 4.16(1) OF THE ENVIRONMENTAL PLANNING AND ASSESSMENT ACT, 1979

 

A.    Ku-ring-gai Local Planning Panel, exercising the functions of Ku-ring-gai Council, as consent authority, under Section 4.16 of the Environment Planning and Assessment Act 1979, refused development consent to eDA0316/24 for demolition of existing structures, Torrens title subdivision of one lot into two and construction of a new dwelling and associated works on proposed Lot 1 on land at 75 Douglas Street, St Ives for the reasons in the Development Assessment Report (Attachment A1).

B.    Date of decision: 18 December 2024.

C.   Reason for the decision: The Panel concurs with the findings in Council’s Development Assessment report and supports refusal of the application for the reasons in Attachment A1. How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were no submissions.

 

D.   How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were no submissions.

Modification of consent to DA0521/19 (residential flat building) proposing increased building height, relocation of air conditioning units to balconies and roof, addition of a roof top screen for mechanical services, addition of a basement staircase and changes to Conditions 1b, 28, 37 and 100

 

The Panel Resolved:

 

A.    Ku-ring-gai Local Planning Panel, exercising the functions of Ku-ring-gai Council under Section 4.55 of the Environment Planning and Assessment Act 1979, modified the development consent to DA0521/19 in the manner proposed in modification of consent application eMOD0069/24 at 1183 Pacific Highway Turramurra, subject to the recommended conditions as per the of Development Assessment (Modification) Report (Attachment A1).

 

B.    Date of decision: 18 December 2024.

C.   Reason for the decision: The Panel concurs with the findings in Council’s Development Assessment report and supports modification of the application for the reasons in Attachment A1. How community views were taken into consideration: The views of the community were requested by way of notification of the application and there were no submissions.

 

D.   How community views were taken into consideration: The views of the community were requested by way of notification of the application and there was one submission which was considered in the assessment and determination of the application.
