PURPOSE OF THE REPORt
To determine Modification of Consent Application MOD0136/21 to the development consent to DA0101/20, proposing changes in the design and function of the service station to address requirements set out in the conditions and re-wording Condition 75.
This application is reported to the Ku-ring-gai Local Planning Panel as it is a Section 4.55(2) modification application to a development consent that was granted by the Ku-ring-gai Local Planning Panel and relates to development consent conditions recommended by Council officers that were amended by the Ku-ring-gai Local Planning Panel.
PURSUANT TO SECTION 4.55(2) OF THE ENVIRONMENTAL PLANNING AND ASSESSMENT ACT, 1979
THAT the Ku-ring-gai Local Planning Panel, as the consent authority, being satisfied that the proposed modification satisfies Section 4.55(2) and (3) of the Environmental Planning and Assessment Act 1979 and will be in the public interest, modifies the development consent to DA0101/20 in the manner proposed in modification of consent application MOD0136/21 (changes in the design and function of the service station) to address requirements set out in the conditions and re-wording of Condition 75 at 313 Bobbin Head Road, North Turramurra.
