Following a request from Councillor Kay and Councillor A Taylor, the Mayor has called an Extraordinary Meeting of Council to Consider and decide whether to provide a period of public notice on the Review of Environmental Factors for the stormwater and synthetic sports field at Normal Griffiths Oval before proceeding with construction.

Norman Griffiths Oval: Synthetic Field Upgrade
EXECUTIVE SUMMARY
Purpose of Report
To provide Council with a status report for the Norman Griffiths Oval synthetic field upgrade.
Background
The General Manager has received a request for an Extraordinary Meeting of Council to “consider and decide whether to provide a period of public notice on the Review of Environmental Factors for the stormwater and synthetic sports field at Normal Griffiths Oval before proceeding with construction”.
Council has considered a number of reports to upgrade Norman Griffiths Oval. Council resolutions associated with the project (since 2020) are identified below:

Resolved: (Moved: Councillors Clarke/Smith) A. That Council carry out further investigations in relation to installation of synthetic grass at Norman Griffiths Oval including: 1. For staff to provide high level costings to build the field in a manner that handles either a 1% or 2% flood event 2. Complete a risk and hazard assessment (pre and post development) for the key areas (aquatic centre car park and access road; creek adjacent to Scout/Guides Halls and Yanko Road) for all design events (0.2 EY; 10% AEP; 5% AEP; 2% AEP and 1% AEP). Identify other options (and costs) to address risks during an event, such as education, signage, flood markers, road barriers and potentially flashing signs to prevent people driving through flooded roadways during a significant event. 3. Estimate costs for creek stabilisation works (where required) and alternative areas within Bicentennial Park to provide detention prior to Yanko Road, to mitigate some of the increased flow depth at this major road crossing. Resolved: (Moved: Councillors Pettett/Kelly) That: A. Recognising the importance accelerating capital works where feasible to assist with the Covid pandemic recovery, and particularly in light of the opportunities created by the Environmental Planning and Assessment (Local Infrastructure Contributions – Pooling of Contributions) Direction 2020 and the Environmental Planning and Assessment (Local Infrastructure Contributions – Information) Direction 2020, Council fund the shortfall of approximately $1.25 million for the synthetic upgrade of Norman Griffiths Oval from the Ku-ring-gai Contributions Plan 2010 from the “New hockey field and multi-purpose sportsfield” line item. B. Council proceeds to design and construction of a synthetic surface at Norman Griffiths Sportsground this financial year. C. All persons who submitted a response during the public exhibition period be provided an update of the decision. D. The NSW National Parks and Wildlife Service, as a stakeholder, be consulted throughout the development of the project. CARRIED UNANIMOUSLY |

Resolved: (Moved: Councillors Greenfield/Pettett) That: A. As a result of considering the tenders submitted for the proposed RFT9-2021 Design and Construct Stormwater mitigation and synthetic sports field contract, and pursuant to Clause 178(1) of the Local Government (General) Regulation 1995 (“the Regulation”), Council declines to accept any of the tenders. B. Fresh tenders as referred to in clause 178(3)(b)-(d) of the Regulation not be invited due to the current deadlines for the grant funding. C. Pursuant to clause 178(3)(e) of the Regulation, the General Manager enter into negotiations with any person (whether or not the person was a tenderer) with a view to entering into a contract in relation to the subject matter of the tender in terms acceptable to Council’s requirements. D. The Mayor and the General Manager be delegated authority to execute all documents on Council’s behalf in relation to any contract formed as a result of the above. E. Council accept the negotiated tender submission from Tenderer ‘A’ to carry out the Design and Construct – Stormwater Mitigation and Synthetic Sports Field Norman Griffiths. B. Council approve a budget variation to the sum of $409,000 from Section 7.12 plan, project number 109068 to project 107167 – Norman Griffiths Oval Upgrade. C. The Mayor and General Manager be delegated authority to execute all tender documents on Council’s behalf in relation to the contract. D. The Seal of Council be affixed to all necessary documents. E. All tenderers be advised of Council’s decision in accordance with Clause 178 of the Local Government Tendering Regulation. CARRIED UNANIMOUSLY |

Resolved: (Moved: Councillors Pettett/Smith) That the documents stated below are made public, and placed on the Council’s website, when they are approved by Council Staff, and before the construction phase of the Norman Griffiths Oval synthetic turf resurfacing commences. These documents are to include: · the final Review of Environmental Factors, · the final design, including detailed design of all in-fill run-off mitigation devices, · a revised schedule outlining the stages of construction. Council staff have fulfilled the requirements associated with the resolution dated 21 September 2021. The contractor is engaged and has been working with Council staff to develop the design and the Review of Environmental Factors (REF).
Council staff have fulfilled the requirements associated with the final resolution dated 15 February 2022. All documents identified in the resolution were uploaded onto Council’s webpage on Monday 27 February 2023. These documents are also attached to this report.

Environmental Considerations
The REF has identified all environmental considerations and recommendations have been implemented in the design.
Community Consultation
Concerns have been raised by community groups that the 4-6 week consultation period was not carried out as specified in the design and construct contract.
There have been claims by members of the community that the contract for the project showed the contract contractor required a 4-6 week consultation on the design and REF. In June 2021 Council resolved to decline to accept any of the tenders and enter into negotiations with a view of entering into a contract. The correspondence that is being referred to is related to clarifications associated with entering into a contract. It states:
“As per discussion, can
you consider Council’s request listed below and adjust your price and
resubmit accordingly.
· Requirement for an appropriate CDS Gross Pollutant trap as a pre-treatment device to the detention tank system
· Requirement for a project arborist to complete a report and be engaged during the construction
· Engagement of an Environmental Consultant to complete the Review of Environmental Factors (REF). Council issued a draft REF as part of the tender package and there is a requirement for final report to be completed against the final design.
· Allowance for a further 4-6 weeks in the design program to allow for community consultation period. “
It is important to note that the dot points are not related, rather they are points of clarification. Point 4 refers to consultation regarding the design, which was undertaken in March 2022. This included:

Summary
The purpose of this report is to provide Councillors with a status on the Norman Griffiths Oval synthetic field upgrade. Council staff have fulfilled all requirements of the resolutions and on Monday 27 February 2023, uploaded all documents identified by the resolution dated 15 February 2023.
